Oregon’s attorney general has launched an investigation into the Fox Corporation board of directors over their responsibility for Fox News’ airing of false election claims after the 2020 presidential election. That led to Fox’s $787.5 million settlement in April of a case brought by Dominion Voting Systems.
Attorney General Ellen Rosenblum, representing the Oregon Public Employees Retirement Fund, said that the investigation would explore a potential shareholder suit against the board.
“We hope to hold the board accountable and protect the long-term value of Oregon’s investment in Fox Corp.,” Rosenblum said in a statement.
State Treasurer Tobias Read, a member of the Oregon Investment Council, also will take part in the investigation. “Investigating Fox’s books and records is a necessary and significant step in fulfilling our obligation to our beneficiaries,” Reed said in a statement. Rosenblum and Read are both Democrats.

Fox News Channel and Dominion Voting Systems reached a settlement in a $1.6 billion defamation lawsuit just as their much-publicized trial was about to get underway Tuesday.
Per our sister site Variety, the agreement came just before lawyers for both parties were about to give opening statements in Delaware’s Superior Court. Judge Eric M. Davis announced that both factions had “resolved their case.”

Newly revealed recordings of Maria Bartiromo’s conversations with Sidney Powell, Rudy Giuliani and others have left a Delaware judge again upset with Fox’s legal team.
Judge Eric M. Davis indicated Wednesday that he would appoint a special master to investigate Fox’s representations to the court, including declarations made in December over the extent of discovery materials that have been produced to Dominion Voting Systems in their $1.6 billion defamation case.
Davis said that he was “very concerned” that Fox made it seem as if it had met its discovery obligations.
Today, Dominion’s attorneys claimed that Fox withheld key evidence that can be used at the upcoming trial until the last minute, or that there may be more that needed to be produced.
Last week, Fox produced recordings made by Bartiromo’s former producer, Abby Grossberg, who has filed a separate lawsuit against Fox claiming she was instructed...

Update, Wednesday: A Delaware judge again scolded Fox attorneys over the disclosure that Rupert Murdoch is an officer of both Fox News and Fox Corp. and indicated that he is considering whether to issue some kind of a sanction in the case.
Dominion’s attorney Justin Nelson asked Judge Eric M. Davis to issue instructions to the jury that Fox had not been fully forthcoming because of the disclosure. He also said that he would like Fox News and Fox Corp. to be de-consolidated from the cases.
“We have been litigating on this false premise that Rupert Murdoch is not an officer of Fox News,” Nelson said.
Davis said that he would not separate the cases, but left it open as to what other actions he would take.

Rupert Murdoch, Lachlan Murdoch, Fox Corporation board member Paul Ryan and Fox Corp. executive Viet Dinh can be compelled to testify in Dominion’s upcoming defamation trial against Fox News, a judge said on Wednesday.
Delaware Judge Eric M. Davis said that Dominion would have to issue a trial subpoena to force such live testimony, but he would not quash it over issues of inconvenience or because they previously have sat for depositions. Davis cited court precedent that officers, directors and managing agents of a Delaware corporation can be compelled to appear.
“Both Fox and Dominion have made these four parties very relevant,” Davis said.
He added, “If Dominion wants to bring them live, they need to do a trial subpoena and I would not quash it and I would compel them to come.”
He also cited issues with Rupert Murdoch’s deposition and whether questions asked of him were clear or unfairly prejudicial.

Fox News has fired a producer who filed a lawsuit against the network in which she claimed that she was coached and coerced by the network’s lawyers to give misleading deposition testimony in the defense against Dominion Voting Systems’ defamation lawsuit.
The network confirmed that she was dismissed. Fox News contends that she failed to protect privileged company information in her lawsuit.
In her lawsuit, filed in U.S. District Court in New York and Delaware Superior Court on Monday, Abby Grossberg’s attorneys said that she had been put on forced administrative leave, calling it a “blatant display of unlawful retaliation.” They also claimed the network retaliated against her after she complained about unlawful harassment based on her gender and Jewish religion.
In a statement, Fox News said, “Like most organizations, Fox News Media’s attorneys engage in privileged communications with our employees as necessary to provide legal advice.

Former Attorney General William Barr has been subpoenaed in Dominion Voting Systems’ 1.6 billion defamation lawsuit against Fox News, brought by the election systems company last year against the network over claims that the company rigged the results of the 2020 presidential election.
Barr has given deposition testimony to the January 6th Committee in which he said that the claims of election fraud were without merit.
In its lawsuit, Dominion contends that Fox News personalities and guests continued to amplify election fraud claims even after elections officials and Barr said that there was no evidence of widespread fraud. Barr told the Associated Press on Dec. 1, 2020 that they had not seen “anything to substantiate” allegations that election machines were programmed “essentially to skew the election results.”
Barr’s attorney did not immediately respond to a request for comment.

In its lawsuit, Dominion contends that Fox News personalities and guests continued to amplify election fraud claims even after elections officials and Barr said that there was no evidence of widespread fraud. Barr told the Associated Press on Dec. 1, 2020 that they had not seen “anything to substantiate” allegations that election machines were programmed “essentially to skew the election results.”
Barr’s attorney did not immediately respond to a request for comment.

Dominion Voting Systems scored a legal victory in its efforts to hold Rupert and Lachlan Murdoch’s Fox Corp. liable in its defamation lawsuit, not just Fox News, after the network featured guests and personalities who amplified false election rigging claims.
A Delaware judge on Tuesday refused to dismiss Dominion’s case against the parent company, after ruling in December that the voting company’s case against the news network could move forward. The judge, Eric M. Davis, said that Dominion had “pleaded facts sufficient to satisfy Delaware’s minimum pleading standard with respect to Fox Corporation.”
Dominion’s lawsuit claims that even though Rupert Murdoch did not believe then-President Donald Trump’s claims of election fraud, “he nevertheless encouraged on-air personalities to perpetuate these baseless claims.”

A Delaware Superior Court judge denied a Fox News motion to dismiss a massive $1.6 billion lawsuit from Dominion Voting Systems that alleges the news outlet made false claims about the company’s actions and influence on the 2020 presidential election.
In a decision released Thursday afternoon, the court found Fox News’ defenses did not warrant the case being dismissed. “Dominion pleads specific facts that put Fox on notice as to Dominion’s claims. The Complaint, and its exhibits, are detailed and focused, and state a reasonably conceivable defamation per se claim,” said Eric M. Davis in a filing.
However, the judge is at this stage of the proceedings obligated to give Dominion’s claims more weight. “For purposes of the Motion, the Court must view all well-pled facts alleged in the Complaint as true and in a light most favorable to Dominion,” Davis said.

Christopher Wheeler, 54, was arrested last November after cops searched his home, office and private plane following allegations of child sex abuse made by two Pennsylvania brothers, the News Journal reports. The former Tower Hill School headmaster was not charged with abuse, but the search led authorities to find the disturbing images and charge him on 25 counts of child pornography instead. He was convicted on all counts. Defense attorney Tom Foley argued that prosecutors could not prove that Wheeler had viewed the images or even downloaded them.
