The Los Angeles County District Attorney’s office declined to file charges Friday against Murray Miller, a writer for HBO’s “Girls” who actress Aurora Perrineau accused of sexually assaulting her in 2011, when she was underage.
The D.A.’s office said it investigated the possibility of charging Murray with one of two crimes: rape, specifically with an unconscious victim, and statutory rape.
Prosecutors said the three-year statute of limitations has expired on statutory rape, and declined to prosecute on the other rape charge, citing “inconsistencies and the delay in reporting.”
“[T]here are inconsistencies which cannot be overcome,” the Da’s office said in a declination of charge document.

The Girls writer who was accused of sexually assaulting actress Aurora Perrineau is retracting a previous statement claiming she demanded money from him.
“In a previous statement to media, we stated that Ms. Perrineau sought substantial monetary damages from our client Murray Miller. Neither Ms. Perrineau nor her attorneys have ever made a demand for money,” Murray Miller’s attorneys, Donald Walerstein and Matthew Walerstein, said in a statement obtained by People on Thursday. “Our previous above statement was incorrect and the result of a good-faith misunderstanding.”
Last month, Perrineau accused Miller of sexually assaulting her in 2012 when she was 17 years old.

Actress Aurora Perrineau has gone to police to accuse “Girls” writer and executive producer Murray Miller of raping her in 2012, when she was 17 years old, TheWrap has exclusively learned. Perrineau, who has appeared in Jennifer Lawrence’s “Passengers” and is the daughter of “Lost” actor Harold Perrineau, told TheWrap she filed a report with the Los Angeles County Sheriff’s Department on Friday. John Cena and Kumail Nanjiani are set to co-star in an untitled buddy cop comedy that will be helmed by Zombieland director Ruben Fleischer. Deadline Hollywood reports that Universal has acquired the project that is written by Murray Miller (Tour De Pharmacy and 7 Days in Hell).
David Bernad and Fleischer most recently produced Brie Larson’s directorial debut Unicorn Store, and Bernad produced Mike White’s critically acclaimed Brad’s Status, both of which premiered at the Toronto Film Festival.
There aren't many detials on the project, and I don't know about you, but seeing Cena and Kumail together could be magical. Both are very funny actors and are physically opposite. I think it could make for a great and funny film!
