Actor Jeffrey DeMunn reprises the role of Professor Norman Rothenberg in this episode, Rothenberg is a professor of criminal law at Hudson University and also a part-time defense attorney. He appeared as Rothenberg in eight episodes of Law & Order (1990). DeMunn has also played a few other characters in the L&O franchise:

Rothenburg states that in addition to second degree murder his client is facing an aggravated rape charge. However in the state of New York there is no such charge as aggravated rape, there is just 3rd, 2nd and 1st degree rape.
There is however an aggravated sexual abuse charge (ranging from 4th to 1st degree). Aggravated sexual abuse is charged when one person inserts either a finger or foreign object into another person's anus, penis, vagina or urethra. The degree that is charged depends on whether the victim was incapacitated, unable to consent due to being under-age or mental disability, was forcibly compelled to allow the action and by physical damage caused by the act.
In this instance the appropriate charge would be rape in the second degree, which is charged when one person has sexual intercourse with someone who is physically incapacitated (in this case passed out due to alcohol intoxication).
