- Clum and others want Earp to take a posse after the men he was forced to release but Earp declines. With Behan as the sheriff of the new Cochise County it becomes his task. When they give themselves up, Earp questions Behan's loyalties.
- Earp was forced to release the four men who robbed a stagecoach and murdered a guard to save the wounded Shotgun Gibbs. John Clum and others want to form a posse for Earp to lead to recapture the men but Earp would prefer to catch them one by one without a posse to prevent any citizens from being hurt. The Ten Percent Ring in Tucson gives Old Man Clanton orders to have the four men give themselves up in the new Cochise County as they won't be convicted. The new sheriff of Cochise County, Johnny Behan, is given orders to eliminate the only witness to the holdup and murder which he reluctantly agrees to do. In Tombstone Behan gives the news to Earp that Behan is the new sheriff so Earp turns in his Pima County star although Behan wants him as his top deputy. Furthermore, Behan says he has told Clanton to turn in the four men. The men surrender but Earp is still suspicious. The Citizens Safety Committee decides to name Clum as mayor so he can name Earp a city deputy. As the men come to trial, Behan's plan to free the men and carry out the Ten Percent Ring orders works putting Earp on notice.—Anonymous
